HomeMy WebLinkAbout2024-16 - Amend Chapter 28, Division 4 of the Code of Ordinances, Regarding Disconnection of Water for NonpaymentDOCSOPEN\FA105\5\977313.v4-9/18/24 CITY OF FARIBAULT ORDINANCE No. 2024-16 Amend Chapter 28, Division 4 of the Code of Ordinances, Regarding Disconnection of Water for Nonpayment THE CITY OF FARIBAULT ORDAINS that the City Code of Ordinances shall be amended by the deletions fo the stricken language and the additions in underlined language as follows: Section 1. Chapter 28, Water, Division 4, Rates and Charges Sec. 28-71. - Same—Collection; receipts for payment; delinquent list; report to city administrator; etc. The city administrator shall receive all monies from all persons or consumers of water shown by the statement of the water division of the department of public works to be due. Upon payment by any person of the water charges so charged, the city administrator shall give such person a suitable receipt and endorse on the proper places on such statement the time and amount of such payment. On the sixth (6 th ) day of the month after receiving copies of such statements, the city administrator shall make out and deliver to the water division superintendent a statement or list of all persons who shall have failed to make payment of water charges so charged against them. It shall be the duty of the city administrator to preserve all of the copies of statements delivered by the water division superintendent and return the same with an official receipt for the amount collected to the financial records in the office of the city administrator on or before the last day of each month. Sec. 28-72. - Same—Turning off service. (a) It shall be the duty of the water division superintendent, upon receiving, pursuant to section 28-71 of this division, the list or statement of such persons who shall have failed to pay water bills by the sixth (6 th ) day of the month following receipt of the bill, to forthwith make a diligent effort to enforce payment, and. The failure by the a consumer to pay a service account within a reasonable time thereafter shall be deemed sufficient cause for turning off the water and implementing collection for the service to such premises. Water service will generally not be disconnected for non- payment, except in special circumstances where the integrity of the water system is in question. (b) When a consumer's water has been turned off it shall not be turned on again until payment of disconnection processing fee, in addition to full payment of delinquent water rent. The disconnection processing fee shall be set by the city council in the fee schedule. Water rent shall be a charge against the owner, lessee or occupant of the premises and shall constitute a lien against the lot or parcel served and in the event of delinquency, the city administrator may commence legal action to collect such unpaid rent or certify such delinquency to the county auditor to be assessed against such lot or parcel and collected with real estate taxes. Section 2. This ordinance amendment shall take effect and be in force after its passage and publication in accordance with Section 3.05 of the City Charter.
