Proclamation
WHEREAS, the City of Faribault wishes to honor its own rising poker star, Ian
Matakis; and
WHEREAS, Ian Matakis was raised in Faribault, found his interest in poker
here; and still calls Faribault home; and
WHEREAS, he began his professional poker career online, but has now
found himself traveling across the United States playing in more live events; and
WHEREAS, he won his first World Series of Poker (WSOP) gold bracelet in
the second WSOP online event in 2023, and continued to place well at in-person and
online tournaments; and
WHEREAS, his continued success resulted in being crowd the 2023 WSOP
Player of the Year, and will now have a Player of the Year banner in the Horseshoe
Grand Ballroom in Las Vegas, and a seat at the WSOP Main Event in 2024.
NOW THEREFORE, I, Kevin Voracek, Mayor for the City of Faribault, do
hereby proclaim Tuesday, August 22, 2023 as
“Ian Matakis Day”

SUBJECT: Introduction of Police Officer Jason Witt
Background:
Officer Jason Witt began his employment as a police officer with the City
of Faribault on July 17, 2023. As an experienced officer, an accelerated
Field Training Officer (FTO) was completed by Officer Witt and he was
certified for solo patrol on August 15, 2023. The Department wishes to
formally recognize and welcome Officer Witt before the City Council.

Call to Order/Roll Call/Pledge of Allegiance
The meeting of the City Council was called to order by Mayor Kevin Voracek at 6:00 p.m. Councilors
Sara Caron, Adama Doumbouya, Royal Ross, Peter van Sluis, Tom Spooner and Chuck Thiele were in
attendance. Also in attendance were City Administrator Tim Murray, City Clerk Heather Slechta, Parks
and Recreation Director Paul Peanasky, City Engineer Mark DuChene, Community & Economic
Development Director David Wanberg, Public Works Director Travis Block and Police Chief John

Public Hearings
Proposed Interim Ordinance Authorizing a Study and Moratorium on Cannabis Businesses
City Clerk Heather Slechta stated that on July 25, 2023, the City Council directed staff and the City
Attorney to draft a moratorium on cannabis businesses. Cannabis businesses are businesses that deal

in products that are made from cannabis plants containing more than 0.3% THC – this does not include
hemp products which are products made from cannabis plants containing 0.3% or less of THC. Per state
statute the Council must hold a public hearing on the matter.
Motion by van Sluis, seconded by Thiele to open the public hearing and carried unanimously. The public
hearing was opened at 6:02 p.m.
No comments from the public were received.
Motion by Spooner, seconded by Ross to close the public hearing and carried unanimously. The public
hearing was closed at 6:03 p.m.

Proposed Amendments to Chapters 8 and 12 of the Faribault City Charter
City Administrator Tim Murray stated that the City’s Charter Commission meets annually to discuss and
review potential changes to the City Charter. From their meeting held in 2023, the Charter Commission
recommended four amendments to the City Charter to the City Council for consideration. These
recommendations were reviewed at the July 5, 2023 City Council Work Session, with the Council
supportive of all four of the recommended changes—Ordinances 2023-16, 2023-17, 2023-18, and 2023-
19 have been prepared to enact these changes.
Changes to the City’s Charter are governed under Minnesota Statutes, Ch. 410.12. The changes are
made via ordinance. Part of the process to consider adoption of the ordinances is the noticing and
holding of a public hearing on the proposed changes, followed by two readings of the ordinances and a
7/7ths vote is required for passage of each. If approved, staff will publish the ordinances, with the
changes taking effect 90 days afterwards.
Motion by Ross, seconded by van Sluis to open the public hearing and carried unanimously. The public
hearing opened at 6:08 p.m.

Resolution 2023-147 Adopting Special Assessments for a Portion of Special Assessment Roll #S-F1107
Related to the 2017 Street Overlay and Sidewalk Improvements - Contract 2017-02
City Engineer Mark DuChene explained that Resolution 2023-131 adopted on July 11, 2023, declared
the cost to be reassessed and set a special assessment hearing date of August 8, 2023 for the for the
2017 Street Overlay and Sidewalk Improvements project (Contract 2017-02). Notices of the hearing
were sent to the benefited properties and published in the Daily News as required by law.
The City has received no written objections to the proposed assessments.
Resolution 2017-221, adopted on October 24, 2017, following a Public Hearing, accepted the final
Assessment Roll #S-F1107 for the 2017 Street Overlay and Sidewalk Improvements project (Contract
2017-02). The assessment roll included assessments on two common lot parcels, parcel 18.06.4.30.001
in the amount of $2,940.21 and common lot parcel 18.06.4.30.002 in the amount of $3,554.04. These
common lots were part of the Villas of Faribault townhome area, located along Albers Path and Willow
Street. Since the assessments were levied and certified in 2017, no payments have been made on the
assessments and the current balances on the assessments for common lot parcel 18.06.4.30.001 is in
the amount of $3,626.42 and common lot parcel 18.06.4.30.002 is in the amount of $4,383.50.
Recently, these parcels have been placed into a tax-forfeiture state and are being purchased by the
homeowner’s association related to the common lots. During discussions with representatives of the
homeowner’s association, they have indicated that pursuant to Minnesota Statute 515B.1-105(b)(2),
common elements in an Association are not subject to separate taxation or assessment and the
representatives of the homeowner’s association have requested that the unpaid balance of the special
assessments for parcels 18.06.4.30.001 and 18.06.4.30.002, be reassessed as shown on the attached
revised assessment roll.
Minnesota Statute 429.071, subd. 2, states that the City Council may determine based on advice of the
City Attorney that the assessment or proposed assessment or any part thereof is or may be invalid for
any reason, and the council may, upon notice and hearing as provided for the original assessment, make
a reassessment or a new assessment as to such parcel or parcels. Based on this and the advice of the
City Attorney, it is recommended that the Council make a reassessment for parcels 18.06.4.30.001 and
18.06.4.30.002 as shown on the attached revised assessment roll.
The cost of said improvements proposed to be reassessed to the benefiting properties for the 2017
Street Overlay and Sidewalk Improvements (Contract 2017-02) is $8,009.76, which is the original total
assessment amount for the two common lot properties plus interest through calendar year 2023. This
total assessment amount is proposed to be split evenly across the 48 individual owner-occupied
townhomes within the subdivision for a total assessment amount of $166.87/parcel as indicated on the
attached proposed assessment roll. It is proposed to levy the reassessments for 1 year at 7.0% which
is based on the City's current assessment policy of setting the interest rate at the City's current bond
rate plus 2%.

Items for Discussion
Ordinance 2023-15 Amending Chapter 14 of the Faribault City Code of Ordinances (Second Reading)
and Approve Summary Publication
City Clerk Heather Slechta at their July 25, 2023 City Council meeting, the Council approved the first
reading of Ordinance 2023-15 that would amend Chapter 14 of the City Code of Ordinances to allow
licensed tobacco establishments to sell glass pipes, dug-outs, one-hitters, grinders, measuring scales
and small bags. Since its first reading, Staff have not received any public comments and no changes
have been made to the ordinance.

Faribault City Code of Ordinances (Second Reading)

Bids
Resolution 2023-148 Accept Bid for City Hall Improvements
Parks and Recreation Director Paul Peanasky informed the Council that on Thursday August 3, 2023,
bids were received for City Hall Improvements. These improvements include making the restrooms on
the first floor of City Hall ADA compliant as well as adding a wellness room, making City Council
Chambers ADA compliant and renovating the conference room and an office on the third floor of City
Hall. In the 2023 Capital Improvement Budget, $590,000.00 was budgeted for these improvements. Six
(6) bids were received, once bids were tabulated, Met-Con Construction and Brennan Construction of
MN, Inc. both bid $563,000.00.
Since there was a tie, Peanasky recommended that the Council table this item until the August 22, 2023
meeting. Staff are seeking guidance from the City Attorney on this matter as a tie has never occurred
during Peanasky’s tenure with the City.
Motion by Ross, seconded by van Sluis to table Resolution 2023-148 Accept Bid for City Hall
Improvements and carried unanimously.
Boards and Commissions Reports, Announcements and Project Updates
Mayor Voracek informed the Council that on August 17, 2023 an open house to provide input on the
Community Center will be taking place at Buckham West.
Councilor Caron stated that the Pet Parade is this week, Parks and Recreation Director Paul Peanasky
stated that he Pet Parade is on Thursday at 6:00 p.m. The parade will end at Central Park, with line-up
at 2nd Avenue. Ross asked if people need to register prior to the parade, Peanasky stated that they can
register the day of. This year’s theme for the parade is “time travel”.

Agreements
Background:
Annually, numerous civic/non-profit organizations request funding from
the City. As part of the 2024 budgeting process, the Council decided to
enter into five-year agreements with the following organizations:
• Faribault Community Television
• Faribault Festivals
• Buckham West (Senior Center)
• Rice County Historical Society
Entering into five-year agreements will assist both the City and the
civic/non-profit organizations with their annual budgeting process. Each
of the attached agreements outline how payments will be made as well as
the amounts that will be provided each year. A 5-year agreement has
previously been approved and executed with the Faribault Foundation, and
similarly, a new 5-year agreement with the River Bend Nature Center is
currently under consideration, and will be brought back separately at a
future meeting.

Faribault Community Television -2024 - 2028 Agreement
1. RECITALS
1.1 Charter Communications holds a franchise pursuant to Ordinance No. 2008-
23, provides a public access channel for public, educational and government access
as required by the franchise with the City.
1.2 Consolidated Communications holds a franchise pursuant to Ordinance
2006-1 1, provides a public access channel for public, educatronal and government
access as required by the franchise with the City.
1.3 FCTV is a non-profit community based corporation engaged in developing
non-commercial programming for transmission over the public access channel(s),
and it offers opportunities for youth and others to participate in the creation and
presentation of television programming.
1.4 The purpose of this Agreement is to designate FCTV as the manager on
behalf of the City for lhe public access channel(s). The City Council finds that
FCTV's demonstrated interest in the area of public access programming enables it to
bring together people with the interest and expertise to effectively promote and
facilitate use of this public resource.
2. GENERAL CONDITIONS
2.1 This agreement shall take effect on January 1 , 2024 and shall be in effect
untif December 31, 2028.
2.2 This agreement may be amended or changed from time to time upon mutual
agreement of the parties.
2.3 This agreement shall replace and repeal all previous agreements with regard
to operations, maintenance, and financial responsibilities of the parties.
3. CITY OBLIGATIONS
3.1 The City shall provide funding as follows: 0.3100% of the most recently
audited General Find revenues to fund FCTV's activities. For 2024, that amount will
be $58,211.00. Payments will be made in quarterly installments provided that this
Agreement has not been terminated, in which case a pro-rata share based on twelve
months shall be paid. The City will attempt to provide FCTV with the amount of next
year's funding by July 1'' of the year prior.
This is an agreement between the City of Faribault, a municipal corporation, hereinafter
referred to as "Caty", and Faribault Community Television and Multimedia Center, lnc., a
Minnesota non-profit corporation, hereinafter referred to as "FCTV".

3.2 FCTV is hereby appointed to manage in the public interest the public access
channel and the equipment and other resources made available to the public
pursuant to the cable franchise.
4. FCTV's OBLIGATIONS
4.1 FINANCIAL. FCTV shall develop a budget, a copy of which shall be filed with
the City. FCTV shall develop other sources of revenue such as grants and user fees
to cover its expenses in excess of the funds provided by the City. FCTV shall
establish written procedures for financial management and accounting and shall file
a copy with the City-
4.2 INSURANCE. FCTV shall obtain general liability insurance covering its
activities, staff and volunteers, including an appropriate rider for defamation claims.
The City shall be named as an additional insured, and the policy shall provide that it
will not be cancelled without written notification of the City. FCTV maintain liability
insurance at State mandated municipal levels. FCTV shall indemnify the City of any
and all liability claims made against the FCTV resulting from the operation of any
FCTV program or activity sponsored by the FCTV. FCTV shall maintain Workers'
Compensation lnsurance meeting the requirements of state law and shall provide
proof of coverage to the City.
4.3 POLICIES AND PROCEDURES. The FCTV board shall develop and publish
policies and procedures to ensure fair access to the public access channel and
resources by the citizens. The board shall adopt policies to ensure that transmitted
programming is not obscene or otherwise unlawful. Copies of all policies and
procedures shall be filed with the City.
4.4 OPERATING AGREEI\,4ENTS. FCTV may enter into operating agreements
with lndependent School District #656, the franchisee and others as necessary,
provided that no such agreement shall be deemed to be a contracl of lhe City without
the written consent of the City. Copies of all such agreements shall be filed with the
City.
4.5 COMN/UNITY ASSISTANCE. FCTV shall develop programs to provide
training and education opportunities for youth and other members of the community,
and technical assistance to persons seeking to use the public access channel and
equipment.
4.6 DATA. Data provided to the FCTV under this Agreement shall be
administered in accordance with the Minnesota Government Data Practices Act,
Minnesota Statutes, Chapter 13.
5. GOVERNMENTACCESS
Transmission of local government meetings shall be without charge and shall be priority
programming.

6. FCTV ASSETS
ln the event that FCTV shall cease operations, the City, jointly with ISD #656, may assume
ownership of the assets of FCTV. This right may be exercised solely in the discretion of the
City Council and School Board and does not imply a duty to assume the obligations of FCTV
except to the extent of the lien on any asset the City or District chooses to take pursuant to
this provision.
7. FCTV INDEPENDENT CONTRACT
FCTV is an independent contractor and no employees of FCTV shall be considered
employees of the City.
8. REPORTING
FCTV shall submit a written report to the City Council by lvlarch 31"'following the years
2024-2028, describing FCTV's efforts to promote use of the public access channel, and to
meet its obligations under this Agreement. The report shall include a financial statement
and a breakdown of charges and fees.
9. TERMINATION
This agreement shall terminate on December 31,2028, or earlier under one or more of the
following circumstances:
1 . Upon mutual agreement of the City and FCTV.
2. FCTV ceases to be registered or operate as a non-profit corporation.
3. FCTV ceases to perform one or more of the obligations outlined herein (City to
provide 90-days' notice outlining obligation(s) not being fulfilled).

Faribault Community Festivals -2024 -2028 Agreement
This is an agreement between the City of Faribault, a municipal corporation, hereinafter referred
to as "City", and the Faribault Community Festrvals, lnc., a nonprofit corporation, hereinafter
referred to as "Festivals".
Whereas, Festivals is established to hold community festivals; and
Whereas, the City has a desire and a need to provide a community festival with musical events
and other entertainment.
Now, therefore, it is agreed
The City's Obligations
1. Provide annual funding as follows: 0.0400% of the most recently audited General Fund
revenues for the underwriting of the direct and indirect costs of musical events and teen
activities related to Faribault Heritage Celebration. For 2O24, the amount will be
$7,51 1.00. Payments will be made by February 1 of each year. The City will attempt to
provide Festivals with the amount of next year's funding by July 1"'of the year prior.
2. To provide the use of Central Park to Festivals for the Faribault Heritage Celebration
without cost, and provide public safety and public works support for the celebration
activitres.
The Festival's Obligations
The City and Festivals Agree
1. This agreement shall take effect on January 1, 2024 and shall be in effect until
December 31 , 2028.
2. This agreement may be amended or changed from time to time upon mutual
agreement of the parties.
1. Festivals will be self-sufficient with regard to funding for Faribault Heritage Celebration.
2. Festivals will hold a parade, dances, free musical events and other community
events.
3. Festivals shall indemnify, defend and hold harmless the City from any and all claims
made against the City resulting from the City's involvement and participation in Faribault
Heritage Celebration sponsored by Festivals.
4. Festivals shall be responsible for privately obtaining and maintaining program
and activity liability insurance for all activities, and insuring all staff and program
activities. Festivals shall furnish certificates of insurance providing public liability,
Workers' Compensation including employers liability, dram shop and other coverages as
may be deemed appropriate by the City naming the city as an "additional insured" with
respect to the City's involvement and participation in Faribault Heritage Celebration.
5. Festivals will maintain their own financial accounting system.
6. Festivals shall submit a financial report and an annual program performance report to
the City on or before March 3'1"'following the years 2024-2028.
7. At all times, and for all purposes hereunder, Festivals is acting as an independent
contractor, and no employees of Festivals shall be considered employees of the City. lt
is recognized that the City does not control the means or manner of performance of any
Festivals employees, the setting of wages, or the right of the employer to discharge
employees.
8. Data provided to Festivals under this agreement shall be administered in accordance
with the Minnesota Government Data Practices Act, Ivlinnesota Statutes, Chapter 13.

Rice County Historical Society – 2024 - 2028 Agreement
This is an agreement between the City of Faribault, a municipal corporation, hereinafter
referred to as “City”, and the Rice County Historical Society, a nonprofit corporation,
hereinafter referred to as “the RCHS”.
Whereas, the RCHS owns and maintains the Alexander Faribault House (“House”) located at
12 NE First Avenue for the purpose of preserving this historic property and to allow public
viewing of the property; and
Whereas, the City wishes to ensure the House is preserved and open to the public because
of its significance in the development of the City of Faribault.
Now, therefore, it is agreed:
The City’s Obligation:
1. Provide annual funding as follows: 0.0750% of the most recently audited General Find
revenues for the underwriting of the direct and indirect costs of the maintenance and
operation of the Alexander Faribault House property. For 2024, this amount will be
$14,083.00. Payments will be made in two equal payable March 1 and September 1.
The City will attempt to provide the RCHS with the amount of next year’s funding by
July 1st of the year prior.
The RCHS’s Obligations:
1. The RCHS will be self-sufficient with regard to funding for the House.
2. The RCHS will maintain the House in a sound and safe manner in conformance
with Minnesota Historical Society standards. The House will be open to the public on
a regular basis.
3. The RCHS shall indemnify, defend and hold harmless the City from any and all claims
made against the City resulting from this agreement.
4. The RCHS shall be responsible for privately obtaining and maintaining liability
insurance for all activities, and insuring all staff and program activities. They shall
furnish certificates of insurance providing public liability, Workers Compensation
including employer’s liability and other coverages as may be deemed appropriate by
the City naming the city as an “additional insured” at levels required by the City.
5. The RCHS will maintain their own financial accounting system.
6. The RCHS shall submit a financial report and an annual program performance report
to the City on or before March 31st following the years 2024-2028.
7. Data provided to the RCHS under this Agreement shall be administered in accordance
with the Minnesota Government Data Practices Act, Minnesota Statutes, Chapter 13.
8. The RCHS shall provide to the City Council a long-range maintenance program for the
Faribault House by March 31st following the years 2024-2028.
9. At all times, and for all purposes hereunder, the RCHS is acting as an independent
contractor, and no employees of RCHS shall be considered employees of the City. It

any RCHS employees, the setting of wages, or the right of the employer to discharge

The City and RCHS Agree:

Faribault Area Senior Citizens – 2024 - 2028 Agreement
This is an agreement between the City of Faribault, a municipal corporation, herein referred
to as the “City”, and the Faribault Area Senior Citizens, Inc., a nonprofit corporation,
hereinafter referred to as “the Seniors”.
Whereas, the Seniors have established a nonprofit organization to address the needs of our
community’s elderly population; and
Whereas, the City wishes to assist the Seniors in accomplishing their mission; and
Whereas, a lease and development agreement, approved October 28, 2014, exists between
the City and the Seniors, and this agreement has been reviewed as provided for.
Now, therefore, it is agreed:
The City’s Obligations:
1. Seek advice from the Board of the Seniors on policy matters affecting the Faribault
community elderly population.
2. Provide annual funding as follows: 0.2500% of the most recently audited General
Fund revenues for programming to the senior population in the community. For 2024,
this amount will be $46,944.00. Payments will be made in two equal amounts on
February 1 and September 1 of each year. The City will attempt to provide the
Seniors with the amount of next year’s funding by July 1st of the year prior.
3. Continue to assist the Seniors in the development of senior center programming
through the Buckham Center.
The Seniors’ Obligations:
1. The Seniors shall be self-sufficient with regard to funding the senior program.
2. The Seniors will provide a program of service to the Faribault senior community
involving respite care, support services, recreation, social services, and other
services to meet the unique needs of the senior population.
3. The Seniors shall indemnify and defend the City for any and all liability claims made
against the Seniors resulting from the operations of any senior program or activity
conducted or sponsored by the Seniors.
4. The Seniors shall be responsible for privately obtaining and maintaining program and
activity liability insurance for all senior activities, insuring all staff and volunteers, and
all program activities. Seniors shall maintain workers’ compensation insurance as
required by law. Seniors shall file proof of any required insurance policies with City
administration.
5. The Seniors will maintain their own financial accounting system, and submit an
annual financial report for each calendar year.
6. The Seniors shall submit a financial report and an annual program performance
report to the City on or before March 31st following the years 2024 through 2028.

7. At all times and for all purposes hereunder, the Seniors are acting as an independent
contractor and no employees of the Seniors will be considered employees of the City.
It is recognized that the City does not control the means or manner of performance of
any Senior employees, the setting of wages, or right of the employer to discharge
employees.
8. Data provided to the Seniors under this agreement shall be administered in
accordance with the Minnesota Government Data Practices Act, Minnesota Statutes,
Chapter 13.
The City and Seniors Agree:
1. This agreement shall take effect on January 1, 2024 and shall be in effect until
December 31, 2028.
2. This agreement may be amended or changed from time to time upon mutual
agreement of the parties.
3. This agreement shall replace and repeal all previous agreements with regard to
operations, maintenance, and financial responsibilities of the parties.
4. The Faribault City Council shall appoint one member to serve as a liaison to the
Buckham West (Senior Center) Board of Directors. This member has non-voting
privileges and the position will be reviewed annually.
This agreement shall terminate on December 31, 2028, or earlier under one or more of the
following circumstances:
1. Upon mutual agreement of the City and the Seniors.
2. The Seniors cease to be registered or operate as a non-profit corporation.
3. The Seniors cease to perform one or more of the obligations outlined herein (City to
provide 90-days’ notice outlining obligation(s) not being fulfilled).

Replacement Project - Contract 2023-08
Background:
The Council adopted the 2023-2027 Capital Improvement Plan that
included the construction of a new TH 3 trunk sanitary sewer line to provide
relief to the existing TH 3 trunk sanitary sewer line that is undersized. The
proposed trunk sewer line will be parallel to the existing line but be outside
of the TH 3 road surface. A part of this trunk sewer line is proposed to run
through a portion of the Rice County Fairgrounds. The City and Rice
County, which owns the fairgrounds, have negotiated a permanent utility
easement and temporary construction easement to facilitate the
construction of the proposed trunk sewer line.
A copy of the proposed easement is attached and the cost of said easement
is $3,000. Note, the proposed easement agreement also allows for the City
to construct an RV sewer dump station on the fairgrounds property. Said
RV dump station will be a self-serving dump station, owned, maintained
and operated by the City. The proposed trunk sewer line project is in final
design stages awaiting final permitting approval from MNDOT and the
Canadian Pacific railroad. It is intended to bid this project this year with
construction starting yet in 2023 and either finishing in 2023 or spring of
2024.

A. Owner is the fee owner of certain real estate (the “Property”) in Rice County, Minnesota:

Easements
I. Grant of Easements. For good and valuable consideration, as detailed in Clause II (15) of this
Easement, Owner hereby grants and conveys to the City, its successors and assigns, the following

A. Easement. A permanent easement for utility purposes over, under, across and through
that part of the Property as described and shown on the attached Exhibit “B”. This
Easement shall give the City the right to construct, use and maintain sanitary sewer
underground utilities within the Easement.
B. Temporary Easement. A Temporary Easement for grading, stockpiling, drainage and
construction purposes over, under across and through that part of the Property as
described and shown on the attached Exhibit “C”. The Temporary Easement shall
expire on December 31, 2024 or upon project completion, whichever is earlier.
II. The Easement and Temporary Easement shall be granted subject to the following conditions:
1. The Easement shall remain subject to sale or lease; such sale or lease shall not serve to
revoke the Easement.
2. Before any action involving this Easement, a director, board member or committee
member having a Conflict of Interest and who is in attendance at the meeting shall
disclose all facts material to the Conflict of Interest and shall refrain from commenting
or voting upon the action. Such disclosure and recusal shall be reflected in the minutes
of the meeting.
3. City shall comply with all applicable local, state, and federal laws, rules, or regulations
affecting said Easement.
4. The Easement shall not be assignable by City except upon written consent of Owner,
except that City is granted the right and authority to permit and regulate the use of the
permanent easement areas by private utilities in accordance with City regulations.
5. Any repair, modification or maintenance of the sanitary sewer line will be the sole
responsibility of City, its successors and assigns in perpetuity. Any deviation from the
location and layout of the sanitary sewer line from the attached exhibits will require the
written consent of Owner.
6. City shall coordinate construction plans and efforts with Owner’s engineer, Dennis
Luebbe or his successor or assign, regarding any excavation affecting Fairgrounds
Drive, Faribault, Minnesota.
7. If, during construction, it is necessary for plans to deviate from the plan as stated herein,
City will notify Owner before alternate plans are explored, Owner must agree in
writing to any deviation from the plan as stated herein.
8. Any damage caused by City in the excavation and construction under, beside or around
Owner’s roadways, in the sole opinion of Owner, shall be repaired by City to Owner’s
specifications.
9. Owner reserves the right to occupy and use said Property for all purposes not
inconsistent with the rights herein granted.
10. City and its authorized agents, including contractor personnel and equipment, are
granted reasonable access over other areas of the Property as may be needed to
construct the improvements within the Easement.
11. Upon completion of construction, City shall restore the permanent easement and
temporary easement areas pursuant to the preconstruction condition.

12. City and Owner agree that each party will be responsible for its own acts and the
results thereof to the extent authorized by law and shall not be responsible for acts of
any others and the results thereof.
13. The Easement shall run with the land unless vacated by majority vote of the City
Council for the City of Faribault.
14. City is granted permission by Owner to create a dump site for vehicles to dispose of
waste material into City’s sanitary sewer. The dump site shall be built at a location
which has been mutually agreed upon by City and Owner. The dump site shall be
maintained solely by City, and its function and operation, as well as any necessary
maintenance and repairs, shall be the sole responsibility of City.
15. City will as its consideration pay to Owner the amount of three thousand dollars
($3,000).
Nothing contained in this Easement shall be deemed a waiver by City of any governmental immunity
defenses, statutory or otherwise. Further, any and all claims brought by Owner, its successors or
assigns, shall be subject to any governmental immunity defenses of the City and the liability limits
provided by Minnesota Statutes Chapter 466. Owner warrants to City, its successors and assigns, that
Owner is well seized in fee of the Property and has good right to grant and convey the Easement and
Temporary Easement and good right to make these grants to City.

Variable Speed Frequency Drives
Background:
The 2023 Capital Improvement Plan (CIP) and budget have approved
$40,000.00 for the purchase of replacement variable speed frequency
drives (VFD’s) at the Water Reclamation Facility (WRF). The drives are part
of the electrical controls that operate process control equipment. The
drives have reached the end of their useful life and need to be replaced to
ensure reliable treatment of wastewater and permit compliance.
Staff solicited quotes for seven replacement drives from Border States
Electric, Faribault, MN for $29,034.55. The replacement drives are the
same brand (Square D) as those being replaced and have provided
excellent performance. Funding will be provided by the Sanitary Sewer
Fund (602).
The VFD’s are eligible for $20,750.00 in electrical rebates from the electric
utility, Xcel Energy. This brings the out-of-pocket cost down to $8,284.55.
Additionally, the new VFD’s will save approximately 250,000 kWH/yr. in
energy use or about $25,000.00/yr.

Background:
The passing of Resolution 2023-118 approved a Rice County Public Health
grant application to partially fund the installation of a bump-out project on
7th St. NW at Lincoln Ave. NW. The project consisted of installing
temporary measures in the spring through fall to improve the safety of the
crosswalk, specifically during times when school children from Lincoln
Elementary use the crosswalk.
The Statewide Health Improvement Partnership (SHIP), administered by
Rice County Public Health, has approved a mini-grant for the project and
has awarded $1,422.70 in funding for the traffic control materials required
for the project. The City provided $689.28 of in-kind services and a cash
match of $180.50, provided by the Traffic Signs & Signals Fund (101-
43170).

Describe the proposed activity and give a brief background of the need.
a. A traffic study was received for the intersection of 7th St. NW & Lincoln Ave. NW. The request is for
measures to be put in place to improve the safety of the crosswalk, specifically during times when
school children from Lincoln Elementary use the crosswalk. The school presently uses crossing guards
before and after school. The measures are being requested to address motorists who pass on the right
side of vehicles turning south on to Lincoln Ave. NW from 7th St. NW from both east and west, this
could be a potential safety hazard. It should be noted that school zone speed limits were implemented
in August of 2020 as part of an initial request to make safety improvements at this intersection. Staff has
reviewed the area several times and has determined that a rapid flashing beacon crosswalk similar to
the one in place by the government center is not recommended. One option would be to install a bump
out to help prevent issues with drivers passing on the right. In this situation, a demonstration bump-out
could be installed under guidance published by the Minnesota Department of Transportation. The
installation will be designed and materials procured and installed summer 2023, a temporary layout is
currently in place. The plan is to install it each spring and leave it in until late fall, remove it before
winter. The installation of the project would be pending compatibility with school bus operations.

Background:
Staff has been working with the Minnesota Department of Health (MDH) at
their request, on sealing two wells at the old water pumping station site.
The wells were taken out of production in the 1940’s and filled and
abandoned in the late 1960’s.
Staff is working with our MDH Source Water Protection Planner on an
application for grant funding for the project. The funding is available
through the Minnesota Board of Water & Soil Resources (BWSR) Clean
Water Fund Competitive Grants Program. Under the program, funding is
available for activities that restore, protect and enhance water quality. The
submittal deadline is August 24, 2023.
The cost estimate for the project is $225,000.00. The City match for the
grant is ten percent of the funds requested or received. The match must
be cash or in-kind cash value of goods, materials, and services directly
attributed to project accomplishments. Project grants will be awarded in
December and executed in April 2024. Matching funds will be provided by
the Water Fund (601).

SUPPORT COMMUNITY ACTION CENTER’S EFFORTS TO ESTABLISH
EMERGENCY HOUSING INFRASTRUCTURE IN FARIBAULT
WHEREAS, in 2021, Rice County had roughly 222 unsheltered households, of
which 65 of the households included children; and
WHEREAS, roughly 35 families in Faribault public schools in the 2022-2023 school
year did not have stable housing; and
WHEREAS, the Faribault Police Department has seen a growing number of
individuals who have requested emergency housing, especially during periods of
extreme cold; and
WHEREAS, the Housing and Redevelopment Authority of Faribault, Minnesota (the
“HRA”) has helped address homelessness issues by providing hotel vouchers for
those in need of emergency housing; and
WHEREAS, the HRA does not view its hotel voucher program as a sustainable
solution that adequately addresses Faribault’s emergency housing needs; and
WHEREAS, the City and the HRA have limited resources to address emergency
housing needs on their own, but the City and HRA can provide in-kind and/or
supplementary support to other organizations that are better suited to address
emergency housing needs; and
WHEREAS, Community Action Center (CAC) – a nonprofit community organization
serving Rice County individuals and families - requests that the Faribault City
Council support its efforts to obtain a grant through the Minnesota Department of
Human Services to establish emergency housing infrastructure in Faribault; and
WHEREAS, CAC intends to develop, own, and manage two or three emergency
housing duplexes in Faribault; and
WHEREAS, the City Council’s contribution to CAC’s emergency housing efforts may
include buying down land costs and similar contributions.
NOW, THEREFORE, BE IT RESOLVED, by the Faribault City Council as follows:

Background:
Ryan Miryala, with Recyy Recycling LLC, has requested a zoning text
amendment to allow limited commercial collection of recyclable electronic
devices in Commercial Districts. Recyy is an electronic device recycling
(e-waste) collection center business planning to open a limited recycling
collection center at 1001 Division St. W in the C-2, Highway Commercial
District. Currently, zoning regulations permit recycling center uses in
industrial districts, but they are not included in the list of permitted or
conditional uses in commercial districts. Staff prepared a draft ordinance
that includes a definition of a Recycling Facility (currently permitted in
industrial districts) and Limited Recycling Collection Centers. Staff also
prepared draft Development Standards for Limited Recycling Collection
Centers in the C-2 and C-3 districts. Refer to the attached detailed staff
report for additional information.
The Planning Commission held a public hearing on August 7, 2023,
regarding the draft ordinance. No one from the public attended the
hearing nor submitted comments. The Planning Commission unanimously
voted to approve the written findings in the proposed ordinance and
recommend City Council approval. If the City Council approves the first
reading of the ordinance, an associated conditional use permit request for
the proposed Recyy limited recycling collection center at 1001 Division
Street West will be presented with the second reading.

APPROVE ZONING TEXT AMENDMENTS RELATED TO LIMITED RECYCLING
COLLECTION CENTERS IN COMMERCIAL DISTRICTS
WHEREAS, Recyy Recycling has requested a zoning text amendment to
permit limited recycling collection centers accepting electronic recycling
materials (e-waste) and other speficed materials in certain commercial
zoning districts; and
WHEREAS, the Planning Commission, on August 7, 2023, following proper
notice, held a public hearing regarding the proposed zoning text
amendment; and
WHEREAS, following the public hearing, the Planning Commission
recommended that the City Council approve the above-referenced zoning
text amendment based on the following written findings outlined in Section
2-180 of the City’s Unified Development Ordinance as follows:
1.Criteria: Whether the amendment is consistent with the
applicable policies of the City’s Land Use Plan.
Finding: While the processing of recyclable materials is an industrial
activity that could be problematic in a commercial zoning district, the
activity of collecting recyclable electronic materials will be less
intensive and more convenient for residents and local businesses if
conducted indoors in a commercial district and will not be a public
nuisance.
2.Criteria: Whether the amendment is in the public interest and
is not solely for the benefit of a single property owner.
Finding: As the need for electronics recycling becomes more
pressing, an easily accessible recycling drop-off point will benefit the
public.
3.Criteria: Whether the existing uses of property and the zoning
classification of the property within the general area of the
property in question are compatible with the proposed zoning
classification, where the amendment is to change the zoning
classification of a particular property.
Finding: The proposed text amendment does not change the zoning
classification of property in the city. Therefore, this required finding
does not apply to the proposed text amendment.

4.Criteria: Whether there are reasonable uses of the property in
question permitted under the existing zoning classification,
where the amendment is to change the zoning classification
of a particular property.
Finding: The proposed text amendment does not change the zoning

does not apply to the proposed text amendment.
5.Criteria Whether there has been a change in the character or
trend of development in the general area of the property in
question, which has taken place since such property was
placed in its present zoning classification, where the
amendment is to change the zoning classification of a
particular property.
Finding: The proposed text amendment does not change the zoning
classification of property in the city. Therefore, this required finding
does not apply to the proposed text amendment.
WHEREAS, the City Council held a public meeting on August 22, 2023, to
consider approval of the first reading of Ordinance 2023-21; and
WHEREAS, the City Council also held a public meeting on __________, to
consider approval of the second reading of Ordinance 2023-21; and
WHEREAS, based on the City Staff report, the results of the public hearing,
and the written findings and recommendation of the Planning Commission,
the City Council of the City of Faribault concurs with the written findings of
the Planning Commission as stated in the above recitals and makes the
identical findings.
NOW, THEREFORE, THE CITY OF FARIBAULT ORDAINS:
Section 1: Text Amendment – Definitions. The Faribault City Council
adds the following definitions (shown in the underlined text) to Section 1-
120 of the City’s Unified Development Ordinance:
Recycling collection center, limited. A business that collects and
temporarily stores specified recyclable items including electronics recycling
(e-waste) for transfer to another site for processing and recycling.
Recycling facility. A facility that accepts, receives, and processes
materials for recycling. Such facilities may include electronics recycling (e-
waste).

Section 2: Text Amendment - Development Standards. The Faribault
City Council adds the following language (shown in the underlined text) to
the Unified Development Ordinance Section 7-30. Specific Development
Standards:
Recycling collection centers, limited. Located in commercial districts
The following standards allow for convenient and safe disposal of recyclable
household electronic devices and appliances at limited recycling collection
centers in specified commercial zoning districts. The centers are intended
to serve as collection centers, with the processing of the products occurring
at other facilities in appropriate zoning districts. Limited recycling collection
centers in commercial zoning districts must meet the following minimum
standards.
1. Limited recycling collection centers in commercial districts may
accept the following household electronic devices and appliances:
•Electronics recycling devices as defined and regulated by the
State of Minnesota.
•Communication and information technology devices such as
cell phones, computers, smart watches, printers, copiers, and
similar devices;
•Home entertainment devices such as televisions, radios, video
games, remote controls, and similar devices;
•Household appliances such as microwaves, countertop
appliances, ovens, ranges, dishwashers, refrigerators,
freezers, dehumidifiers, and similar devices; and
•Other electronic devices and household appliances for which
the City Council has determined meets the intent of this
ordinance as outlined in the conditional use permit.
2. Limited recycling collection centers in commercial districts are
prohibited from accepting the following:
•Paints, solvents, chemicals, and similar products;
•Plastic, aluminum, and glass containers, scrap metal, and
similar products;
•Vehicles, lawn and garden equipment, and similar products;
•Furniture, mattresses, carpet, building materials, and similar
products; and
•Other products not specifically allowed by this ordinance and
for which the City Council has determined do not meet the
intent of this ordinance.
3. Limited recycling collection centers may collect and temporarily store
household electronic devices, and appliances. No salvage,

reclamation, recovery, or processing of any items, or the re-sale of
any items or parts, or salvaged, reclaimed and/or recovered
materials, is permitted in the centers.
4. All recyclable materials electronic devices and appliances must be
collected and stored inside the building in appropriate containers.
Recyclable materials, shipping containers, and trailers cannot be
stored outdoors. Loading of recyclable materials for shipment to
material recovery facilities must occur in designated loading zones in
the side or rear yard of the site unless specifically allowed otherwise
in the conditional use permit. Curbside collection and after-hours
drop-off are prohibited.
5. The property must be maintained free of litter, junk, and debris.
6. The limited recycling collection center must satisfy any safety
standards and requirements determined by the Fire Chief and other
Safety Code Officials.
7. Limited recycling collection center operators must be registered with
the State of Minnesota and licensed by Rice County for operation in
the City.

Background
Ryan Miryala, with Recyy Recycling LLC has requested a zoning text
amendment to allow commercial collection of electronic waste in
Commercial Districts. Recyy, is an electronic waste (e-waste) recycling
collection center business that is planning to open a small retail collection
center at 1001 Division St. W in the C-2, Highway Commercial District.
Currently zoning regulations permit recycling center uses in industrial
districts, but they are not included in the list of permitted or conditional
uses in commercial districts.
The recycling collection center will accept a variety of electronic items from
households, schools and businesses, including computers, peripherals,
gaming and entertainment systems, phones, fax machines, TVs, monitors,
printers, copiers, household appliances, and similar miscellaneous items.
The items will be brought in by the customers who pay a fee for disposal
of the items. All materials will be stored indoors, in gaylord boxes sorted
by different categories of materials. The gaylord boxes and collected
appliances will be shipped out as needed for processing elsewhere. This
business operation will be a retail recycling collection center only, no
processing is proposed at the collection center.
The collection center will not accept broken CRT TVs, refrigerators, air
conditioners, pressurized canisters, paint, chemicals, oils, broken
fluorescent tubes, car parts, power tools, solar panels, sharps, medication,

hygiene products, thermostats, pressure/vacuum gauges, VHS tapes,
cassettes, compact discs, furniture, mattresses, or any other
damaged/broken e-waste that is non-recyclable.
Business Operation Details.
•The limited recycling center will not include processing.
•The primary purpose is to collect recyclable goods not to process them.
•All processing of recyclables will be done elsewhere
•The primary focus will be on electronic recyclables.
•The recycling related activities will be conducted indoors, thus reducing
any disturbance to surrounding businesses or residences.
Recyy, plans to open similar recycling collection centers in the city of
North Branch and Waconia. A zoning text amendment was also
needed to this use in commercial districts. In North Branch, Recyy,
will be locating in a shopping center. A copy of the North Branch
ordinance is attached with this report.
Discussion - Zoning Text Amendment
North Branch. The City of North Branch provided the following
information based on their discussions of Recyy's application.
Prior to the Recyy application, North Branch only allowed “Recycling
Collection & Process” In I-1 and I-2 districts and even then only by
conditional use permit. The concept in North Branch (and in Faribault) is
for a commercial storefront with a small collection center to provide
consumers with a convenient opportunity and location to dispose of
electronic items and standard household appliances.
They chose to allow “small recycling collection center” in their B (Business)
zone as long as that use complied with specific performance standards.
We recommend a similar approach here.
The Development Review Committee. (DRC) feels that a limited
recycling collection center business conducted fully indoors would be
compatible with uses allowed in commercial districts. An e-waste recycling
collection center use is distinct from recycling processing centers and
when conducted completely indoors, are compatible with other
commercial uses permitted in the C-3 or C-2 District, but not in C-1. In
order to create additional oversight, the DRC is recommending this
use be allowed as a conditional use in these commercial districts

rather than outright permitted uses. The DRC also recommends
recommends specific development standards be established in the
ordinance for this use as well.
Recycling collection center uses (for e-waste) are similar to some of the
uses currently permitted in the C-2 district, such as limited production and
processing up to 2,500 square feet; wholesaling, warehousing, and
distribution; and, essential services (public service and utilities
subsection).
Staff supports the application for a zoning text amendment to allow e-
waste recycling collection centers in the C-2 and C-3 Districts with a
Conditional Use Permit rather than an outright permitted use. Staff is
proposing that performance standards for this use (and conditional use
permit approvals) are needed to appropriately regulate this use in a
commercial district in the public’s interest.
Proposed Performance Standards. The performance standards suggested
for this use are as follows.
1.A small recycling collection center will be defined as a retail business
that exists for the sole purpose of collecting and storing recyclable items
in a retail space not to exceed 3,000 square feet.
2.Retail Recycling Collection Centers shall only include collection of
electronics such as computers, peripherals, gaming and entertainment
systems, phones, fax machines, TVs, monitors, printers, copiers,
household appliances, and similar miscellaneous items.
3.There must be a clear delineation between the retail area and the
collection/storage area.
4.No outdoor storage of any items, including in containers or trailers. All
collected items and storage of material brought in for recycling shall be
enclosed within the principal building on site.
5.Storage and Loading Zones. All recyclable materials shall be collected
and stored internally in appropriate containers. No external storage, or
storage of recyclable materials in shipping containers or trailers shall
be permitted. Loading of recyclable materials for shipment to material
recovery facilities shall occur in designated loading zones to the rear of
the building.

6.Collection. All accepted recyclable materials must be processed through
the retail storefront. Large appliances may be collected at designated
loading zones located to the rear of the retail space. Drive-up and/or
curbside collection and after-hours drop-off shall not be permitted.
7.Prohibited. No salvage, reclamation, recovery or processing of any
accepted items, or the sale of re-sale of any accepted items or parts
thereof or salvaged, reclaimed and/or recovered materials, is permitted
on the property.
8.The property shall be monitored 24 hours a day. And shall be
maintained free of litter, junk and debris.
Discussion - Conditional Use Permit
Comprehensive Plan. The property at 1001 Division St West is guided for
Commercial/Residential Mix use in the comprehensive plan. This usage of
the property will be commercial.
Zoning District. The current zoning at the site is C-2 Highway Commercial.
The site is not located in any overlay zoning districts. The proposed
recycling center use is not currently included as a permitted or conditional
use in this district, and will be subject to approval of proposed zoning text
amendments.
Surrounding Uses. The areas surrounding the proposed recycling
collection center are commercial and residential. It is bordered by a
railroad track to the east.
Development Review Committee. The DRC supports the proposed
conditional use permit for Recyy, Recycling at 1001 Division St W subject
to approval of the proposed zoning text amendments including
performance standards described above.
Recommendations
A.Approve findings in support of the application and recommend City
Council approve the draft Ordinance to allow limited recycling collection
centers in the C-2 and C-3 Districts as a conditional use with specific
development standards based on the written findings.
B.Approve written findings for the proposed conditional use permit for a
limited recycling collection center in the C-2 District at 1001 Division St
and recommend that the city council approve the proposal.

of "protecting and enhancing the environment." The proposed amendment would help to
achieve this goal by reducing the amount of e-waste that ends up in landfills and water
streams.
The proposed amendment is also consistent with the Rice County Solid Waste Management
Plan, which outlines the county's goals and objectives for managing solid waste. The plan
includes a goal of "increasing recycling and reuse." The proposed amendment would help to
achieve this goal by increasing the amount of e-waste that is recycled.
Impacts of the proposed amendment on those affected by it:
The proposed amendment would have a positive impact on those who live and work in the
community. It would help to protect the environment, reduce the cost of waste collection, and
provide educational opportunities about the importance of recycling e-waste.
The proposed amendment would also have a positive impact on the city of Faribault and Rice
County. It would help them to reduce the amount of e-waste that they need to collect and
dispose of. This would save them money and help them to protect the environment.
We urge the city council to approve this important amendment.

AN INTERIM ORDINANCE AUTHORIZING A STUDY AND
IMPOSING A MORATORIUM ON THE OPERATION OF CANNABIS
BUSINESSES WITHIN THE CITY OF FARIBAULT
THE CITY OF FARIBAULT ORDAINS:
Section 1. Legislative Findings and Authority
A. The Minnesota Legislature recently enacted, and the Governor
signed, 2023 Minnesota Session Laws, Chapter 63 – H.F. No. 100
(the “Act”), which is comprehensive legislation relating to cannabis
including, but not limited to, the establishment of the Office of
Cannabis Management (“OCM”), legalizing and limiting the
possession and use of cannabis and certain hemp products by adults,
providing for the licensing, inspection, and regulation of cannabis and
hemp businesses, taxing the sale of cannabis flower, cannabis
products, and certain hemp products, establishing grant and loan
programs, amending criminal penalties, providing for expungement
of certain convictions, and providing for the temporary regulation of
Edible Cannabinoid Products.
B. The Act provides local units of government certain authority related
to Cannabis Businesses, including the authority to (i) require local
registration of certain Cannabis Businesses operating retail
establishments, (ii) adopt reasonable restrictions on the time, place,
and manner of the operation of Cannabis Businesses, provided that
such restrictions do not prohibit the establishment or operation of a
Cannabis Business, (iii) limit the number of certain Cannabis
Businesses based on the population of the community, and (iv)
prohibit the operation of a Cannabis Business within 1,000 feet of a
school, or 500 feet of a day care, residential treatment facility, or an
attraction within a public park that is regularly used by minors,
including a playground or athletic field.
C. The Act requires the OCM, which was established effective July 1,
2023, to work with local governments to develop model ordinances
for reasonable restrictions on the time, place, and manner of the
operation of Cannabis Businesses. The Act also requires the OCM to
establish additional rules and regulations relating to the operation of
Cannabis Businesses. It is anticipated that the city of Faribault (the

“City”) will benefit from reviewing and analyzing the OCM’s model
ordinances, rules and regulations before making any decisions
related to the regulation of Cannabis Businesses in the City.
D. The Act (Minnesota Statutes, section 342.13(e)) expressly allows a
local unit of government that is conducting studies or has authorized
a study to be conducted or has held or scheduled a hearing for the
purpose of considering adoption or amendment of reasonable
restrictions on the time, place and manner of the operation of
Cannabis Businesses to adopt an interim ordinance applicable to all
or part of its jurisdiction for the purpose of protecting the planning
process and the health, safety, and welfare of its citizens. The
interim ordinance may regulate, restrict, or prohibit the operation of
Cannabis Businesses within the jurisdiction or a portion thereof until
January 1, 2025.
E. Given the uncertainty regarding the model ordinances to be
developed by the OCM and the broad scope of the changes to
Minnesota law brought about by the Act, the City desires to adopt an
interim ordinance for the purpose of protecting the planning process
and the health, safety, and welfare of its citizens.
F. The City desires to conduct a study for the purpose of considering
the adoption or amendment of reasonable restrictions on the time,
place and manner of the operation of Cannabis Businesses as well as
the other regulations local units of government may adopt under the
Act.
G. On August 8, 2023, after providing at least 10 days published notice,
the City Council held a public hearing regarding the consideration and
adoption of an interim ordinance prohibiting the operation of
Cannabis Businesses within the City until June 1, 2024.
Section 2. Definitions. For purposes of this Ordinance, the following
terms shall have the meaning given them in this section.
A. “Act” means 2023 Minnesota Session Laws, Chapter 63 (H.F. No.
100).
B. “Cannabis Business” has the meaning given the term in Minnesota
Statutes, section 342.01, subdivision 14.
C. “City” means the city of Faribault, a Minnesota municipal corporation.

D. “Edible Cannabinoid Product” has the meaning given the term in
Minnesota Statutes, section 151.72, subdivision 1(f).
E. “OCM” means the Office of Cannabis Management, established as set
forth in Minnesota Statutes, section 342.02, subd. 1.
F. “Ordinance” means this interim ordinance, which is adopted pursuant
to Minnesota Statutes, section 342.13(e).
Section 3. Study Authorized. The City Council hereby authorizes and
directs City staff to conduct a study regarding the adoption or amendment of
reasonable restrictions on the time, place, and manner of the operation of
Cannabis Businesses, as well as other potential local regulations allowed under
the Act, and report to the City Council on the potential regulation of Cannabis
Businesses. The study may include a review of any model ordinances that
OCM is directed to draft under Minnesota Statutes, section 342.13(d), an
analysis of potential setback regulations allowed under Minnesota Statutes,
section 342.13(c), and such other matters as staff may determine are relevant
to the City Council’s consideration of this matter. The report may also include
City staff’s recommendations on whether the City Council should adopt
regulations and, if so, the recommended types of regulations.
Section 4. Moratorium. A moratorium is hereby imposed on the operation
of any Cannabis Business within the City. During the term of this Ordinance,
no business, person, or entity may establish or operate a Cannabis Business
within the jurisdictional boundaries of the City. Accordingly, during the period
that this Ordinance is in effect, the City shall not accept, process, or act on
any application, site plan, building permit, zoning request, or other approval,
including any requested confirmation, certification, approval, or other request
from the OCM or other governmental entity requesting City review of any
application or proposal for a business proposing to engage in the operation of
a Cannabis Business. During the term of the moratorium, it is a violation of
this Ordinance for any business, person, or entity to establish or operate a
Cannabis Business within the City.
Section 5. Exceptions. The moratorium imposed by this Ordinance does not
apply to: (i) the continued operation of a duly established business as part of
the Medical Cannabis Program administered by the Minnesota Department of
Health that was lawfully operating within the City prior to the effective date of
this Ordinance; or (ii) the sale of Edible Cannabinoid Products under Minnesota
Statutes, Section 151.72, provided, however, that nothing in this Ordinance
exempts a business, person, or entity from complying with all other
requirements and prohibitions of applicable laws and ordinances related to
such exceptions.

Section 6. Enforcement. Violation of this Ordinance is a misdemeanor. The
City may also enforce this Ordinance by mandamus, injunction, or other
appropriate civil remedy in any court of competent jurisdiction. A violation of
this Ordinance is also subject to the City’s general penalties prescribed in the
city code and may further result in the City reporting violations to the OCM, if
relevant to OCM licensing. The City Council hereby authorizes City staff and
consultants to initiate any legal action deemed necessary to secure compliance
with this Ordinance.
Section 7. Severability. Every section, provision, and part of this Ordinance
is declared severable from every other section, provision, and part. If any
section, provision, or part of this Ordinance is held to be invalid by a court of
competent jurisdiction, such judgment shall not invalidate any other section,
provision, or part of this Ordinance.
Section 8. Effective Date And Term. This ordinance shall take effect and
be in force after its passage and publication, in accordance with Section 3.05
of the City Charter. This Ordinance shall remain in effect until June 1, 2024,
or until the City Council expressly repeals it, whichever occurs first.

Background:
Resolution 2023-098, approved by the City Council on May 9, 2023,
authorized the purchase of 422 Park Avenue (the "Property") and
approved a budget amendment for the purchase and demolition of
the structures on said Property. The reason for the purchase of the
Property is to facilitate a future intersection realignment project to move
the intersection of Grant Street and Park Avenue further to the north from
TH 60. The City closed on the purchase of the Property on August 10, 2023,
and is now ready to issue a request for bids for the demolition of the
Property. The attached resolution approves the plans and specs and sets a
bid date of September 7, 2023. Funding for the demolition project will be
paid from the Street Improvement Fund (Fund 401) and is estimated at
$30,000.

the Faribault City Charter
Background:
The City’s Charter Commission meets annually to discuss and review
potential changes to the City Charter. From their meeting held in 2023, the
Charter Commission recommended four (4) amendments to the City
Charter to the City Council for consideration. These recommendations
were reviewed at the July 5, 2023 City Council Work Session, with the
Council supportive of all four of the recommended changes—Ordinances
2023-16, 2023-17, 2023-18, and 2023-19 were then prepared to enact
these changes.
Changes to the City’s Charter are governed under Minnesota Statutes, Ch.
410.12. The changes are made (in accordance with Subd. 7 of the statute)
via ordinance. In accordance with the requirements, a Public Hearing was
held at the August 8, 2023 City Council meeting--there were no public
comments received during the hearing, and following the hearing, all four
ordinances were approved on first reading. Once the ordinances have had
their second reading and been approved (a 7/7ths vote is required for
passage of each), the ordinances will be published in their entirety, with
the changes taking effect 90 days afterwards.
There have been no changes made nor any comments received on these
ordinances since the public hearing and first reading at the August 8 City
Council meeting.

Section 12.04. – Sale of real property.
No real property of the City shall be disposed of except by
ordinanceresolution approved by at least five members of the council. The
initial disposition of the net cash proceeds of any sale of the property shall
be specified in the approving resolutionused to retire any outstanding
indebtedness incurred by the City in the acquisition or improvement of the
property. Any remaining net proceeds shall be used to finance other
improvements in the capital improvement budget or to retire any other
bonded indebtedness.
Section 2. This ordinance shall take effect ninety days after the date
of its publication.

FARIBAULT CITY CHARTER
THE CITY OF FARIBAULT ORDAINS:
Section 1. The City Council of the City of Faribault, pursuant to the
recommendation of the City of Faribault Charter Commission, has hereby
determined that Chapter 12 of the City Charter be amended by adding the
following section in its entirety:
Section 12.09. – Fines and civil penalties.
The Council may provide by ordinance that a violation of a City ordinance
is either a misdemeanor or a petty misdemeanor, punishable in accordance
with State law. The Council shall establish by ordinance a procedure for
imposing a civil penalty known as an administrative offense as defined in
City Code.
Section 2. This ordinance shall take effect ninety days after the date
of its publication.

AMENDING CHAPTER 8. - PUBLIC IMPROVEMENTS AND SPECIAL
ASSESSMENTS OF THE FARIBAULT CITY CHARTER
THE CITY OF FARIBAULT ORDAINS:
Section 1. The City Council of the City of Faribault, pursuant to the
recommendation of the City of Faribault Charter Commission, has hereby
determined that Chapter 8 of the City Charter be amended by the addition
of the underlined language and by the deletion of the stricken language in
Chapter 8 as follows:
Section 8.03. - Certification of Administrative Offense Penalties.
The City may certify unpaid property-based Administrative Offense
penalties by certification to property taxes. Collection of Administrative Offense
penalties shall proceed only in accordance with an ordinance adopted by the
Council that must require at least the following:
The City must give notice to the property owner listed on the official
tax records at least 30 days prior to imposing the certification.
The City must attempt to obtain voluntary payment of the fees and
penalties and allow the property owner the opportunity to request
certification to the property taxes as a method of payment. The City
must provide an opportunity for a hearing regarding the certification
before either the City Council or a neutral third party as specified in
City Code.
Administrative Offense penalties and charges must be directly
related to the property being assessed according to City Code and as
published in the City’s fee schedule. Certifications under this
ordinance shall be imposed pursuant to Minnesota State Statutes
including 366.011, 366.012, 415.01, and 429.101, as amended and
as specified in City Code.
Section 8.034. - Local improvement procedure.
When the City undertakes any local improvement subject to Minnesota law,
it shall comply with the provisions of that law. The council may by resolution
prescribe the procedure to be followed in making any other local improvement
and levying assessments therefor.
Section 2. This ordinance shall take effect ninety days after the date
of its publication.

Improvements
Background:
On Thursday August 3, 2023, bids were received for City Hall
Improvements. These improvements include making the restrooms on the
first floor of City Hall ADA compliant as well as adding a wellness room,
making City Council Chambers ADA compliant and renovating the
conference room and an office on the third floor of City Hall. In the 2023
Capital Improvement Budget, $590,000.00 was budgeted for these
improvements. Six (6) bids were received and tabulated as follows:
Brennan Construction of MN, Inc. $563,000
Met-Con Construction, Inc. 563,000
Professional Contractors (Procon) 576,621
Versacon, Inc. 610,500
Ebert Construction 620,300
APX Construction Group 817,000
The low bid was a tie between Brennan Construction of MN, Inc. and Met-
Con Construction, Inc. at $563,000. To break the tie between the two
bidders, a coin toss will be held at the meeting to determine the selected
bidder. Resolutions are attached for both low-bid companies.
Recommendation:

bidder shall be retained until a contract has been signed.
