HomeMy WebLinkAbout2020-18 - Amending Section 7.14. – Authority for expenditures. of the Faribault City Charter – Second Reading CITY OF FARIBAULT ORDINANCE No. 2020-18 AMENDING SECTION 7.14. — AUTHORITY FOR EXPENDITURES. OF THE FARIBAULT CITY CHARTER THE CITY OF FARIBAULT ORDAINS: Section 1. The City Council of the City of Faribault, pursuant to the recommendation of the City of Faribault Charter Commission, has hereby determined that Chapter 7 of the City Charter be amended by the addition of the underlined language and by the deletion of the stFieken language in Section 7.14 as follows: Section 7.14. - Authority for expenditures. The City Council shall establish a Public Expenditure Policy (the "Policy"), which shall be reviewed and approved by the City Council ann{ta4ynot less often than biannually. In establishing, reviewing, and approving this Policy, the City Council shall consider whether the expenditures to be authorized by the Policy: 1) benefit the community as a whole; 2) are directly related to governmental functions; and 3) primarily benefit the public interest, not a private interest. In establishing, reviewing, and approving the Policy, the City Council shall consider the opinion of the City Attorney and statewide sources of authority, which may include judicial determinations, Minnesota Attorney General opinions, and findings of the Office of the State Auditor. Expenditures related to any of the following activities shall be deemed authorized if the Policy expressly provides authorization: international, cultural, and economic development programs; community events, festivals, and celebrations; miscellaneous employee benefits; employee recognition; and funding for conference attendance. The City Council may also provide specific authorization regarding any other expenditure. Section 2. This ordinance shall take effect ninety days after the date of its publication. Section 1.The City Council of the City of Faribault,pursuant to the recommendation of the City of Faribault Charter Commission,has hereby determined that Chapter 2 of the City Charter be amended by the addition of the underlined language in Section 2.04 as follows: Section 2.04.-Incompatible offices;interest in contract. No member ofthe council shall be appointed city administrator, nor shall any member hold any paid municipal office or employment under the City; and until one year after the expiration of any member's term as mayor or council member, no fonuer member shall be appointed to any paid appointive office or employment under the City which was created or the compensation for which was increased during the member's term as mayor or council member. Except as authorized in Minnesota law,a member of the council who is authorized to take part in any manner in making any sale,lease,or contract in the member's capacity shall not voluntarily have a personal financial interest in that sale, lease,or contract or personally benefit financially therefrom.Except as authorized in Minnesota law at member of the council who is authorized to take art in any manner in any noncontract situation in the member's capacity shall not voluntarily have a personal interest in that non-contract situation or personally benefit therefrom.
