HomeMy WebLinkAbout2013-233 Approve CUP to Allow a Parking Lot as Principal Use for 12 5th St NWState of Minnesota County of Rice CITY OF FARIBA UL RESOLUTION #2013 -233 APPROVE A CONDITIONAL USE PERMIT TO ALLOW DEVELOPMENT OF A PARKING LOT AS THE PRINCIPAL USE ON A PARCEL AT 12 5TH STREET NORTHWEST WHEREAS, State Bank of Faribault, owner of the following property legally described as Lot 002, Block 019, Original Town of Faribault, Faribault, Rice County, MN has requested a conditional use permit to allow development of a parking lot as a principal use on said property commonly known as 12 5th Street Northwest; and WHEREAS, City Staff has completed a review of the application and made a report pertaining to said request (CUP 27 -13), a copy of which has been presented to the City Council; and WHEREAS, the Planning Commission, on the 2 °d day of December, 2013, following proper notice, held a public hearing regarding the request, and following said public hearing recommended approval of the request; and WHEREAS, the City Council, on the 10th day of December, 2013, at a public meeting considered the request; and WHEREAS, based upon said report, hearing, and recommendation, the City Council hereby finds that the conditional use permit to allow development of a parking lot as the principal use on the said parcel is appropriate with the following findings: 1. The conditional use will not be detrimental to or endanger the public health, safety, comfort, convenience or general welfare. 2. The conditional use will not be injurious to the use and enjoyment of other property in the vicinity and will not impede the normal and orderly development and improvement of surrounding property for uses permitted in the district. 3. The conditional use will be designed, constructed, operated, and maintained in a manner that is compatible in appearance with the existing or intended character of the surrounding area. 4. The conditional use will not impose hazards or disturbing influences on neighboring properties. 5. The conditional use will not substantially diminish the value of neighboring properties. 6. The site is served adequately be essential public facilities and services, including utilities, access roads, drainage, police and fire protection, and schools or will be served adequately as a result of improvements proposed as part of the conditional use. 7. Development and operation of the conditional use will not create excessive additional requirements at public cost for facilities and services and will not be detrimental to the economic welfare of the community. 8. Adequate measures have been or will be taken to minimize traffic congestion in the public streets and to provide for adequate on -site circulation of traffic. 9. The conditional use will not result in the destruction, loss or damage of a natural, scenic, or historic feature of major importance to the community. 10. The conditional use is consistent with the applicable policies and recommendations of the city's Land Use Plan or other adopted land use studies. 11. The conditional use, in all other respects, conforms to the applicable regulations of the district in which it is located; and WHEREAS, based upon said report, hearing, and recommendation, the City Council also finds that the proposed parking lot would help alleviate the lack of parking in the area. NOW, THEREFORE BE IT RESOLVED that the conditional use permit to allow development of a parking lot as a principal use on the parcel located at 12 5th Street NW, is hereby granted with the following conditions: 1. Parked vehicles shall be prevented from overhanging the property line. This may be accomplished by placing a fence or sign posts (consistent with the Unified Development Ordinance) at the head of each parking space. 2. The existing parking stripes in 5th Street NW affected by the curb cut serving said parking lot shall be removed and modified to the satisfaction of the City Engineer. 3. Signage shall be limited to informational signs consistent with the Unified Development Ordinance. 4. The proposed wrought iron fence shall be allowed to be constructed on the north, east, and west property lines in a manner consistent with the Unified Development Ordinance. The construction documents shall be modified to reflect the proposed placement of the fence. 5. Construction of the parking lot shall begin and be completed as soon as practical in the spring of 2014. ALSO, BE IT RESOLVED that the applicant must comply with all applicable provisions of the City Code of Ordinances during development and operation of the conditional use. Any violation of these provisions or any of the specified conditions shall be grounds for revocation of the conditional use permit in accordance with Article 7, Chapter 2- Administration and Enforcement, Faribault Unified Development Ordinance.
