SUBJECT: Ordinance 2011 -04 Amending Chapter 4 of the
Faribault City Code, Section 4 -11 to Change the
Distance Requirements for Liquor Licenses -
Second Reading
Background: The City Council reviewed the amendment of Ordinance
2011 -04 at its first reading April 26, 2011. The Council discussed
including adding language to `measure lot line to lot line" as presented in
the attached proposed ordinance.
Recommendation: Approve Ordinance 2011 -04 as presented.

AMENDING CHAPTER 4 OF THE
FARIBAULT CITY CODE, SECTION 4 -11 TO
CHANGE THE DISTANCE REQUIREMENT FOR LIQUOR LICENSES
THE CITY OF FARIBAULT, RICE COUNTY, MINNESOTA, ORDAINS that the City
Code of Ordinances shall be amended by the addition of the underlined and the deletion of the
stricken language as follows:
SECTION 1. Section 4 -11 (b) of the Faribault City Code regarding License eligibility for liquor
licenses is amended as follows:
Sec. 4 -11, - License eligibility.
(b)
Ineligible premises. No license shall be granted to:

Any premises upon which taxes or assessments or other financial claims of the city or of the state are
due, delinquent and unpaid;
Any premises that are not compact or contiguous;
Any premises owned by a person who is ineligible under this ordinance. Premises owned by a minor
are not disqualified under this section;
Any place where three and two- tenths (3.2) percent malt beverages are sold for consumption on the
premises; this limitation applies only to off -sale license of intoxicating liquor;
Any establishment classified as an Exclusive Liquor Store located within two hundred fifty (250) feet,
measured lot line to lot line, of any school or church, except in the downtown commercial district:
Any premises where there is lewd or disorderly entertainment likely to become a public nuisance or a
detriment to public morals.
SECTION 2. This ordinance amendment shall take effect and be in force thirty (30) days after its
adoption and publication,

CITY OF FARIBAULT ORDINANCE 2011 -04
CHANGE DISTANCE REQUIREMENT FOR LIQUOR LICENSES
The City of Faribault has approved an amendment to Chapter 4 of the City Code
to not allow a liquor establishment classified as an "Exclusive Liquor Store" to
locate within two hundred fifty (250) feet, measured lot line to lot line, of any
school or church, with an exception in the downtown commercial district.
